Terms of Service

1. Agreement to Terms

By accessing or using services provided by DiVizion Creative Agency (registered in Latvia), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.

2. Services

DiVizion Creative Agency provides creative and digital services including, but not limited to:

• Web design and development
• SEO optimization
• Branding and visual identity
• Digital marketing campaigns
• Print and visual materials
• Technical support and maintenance

The specific scope of services for each project is defined in a separate Statement of Work or project agreement signed by both parties.

3. Client Responsibilities

You agree to:

• Provide accurate and complete information required for the delivery of services
• Review and provide feedback within agreed timelines
• Ensure that any materials you provide (text, images, logos) do not infringe third-party intellectual property rights
• Make payments on time in accordance with the agreed schedule

4. Intellectual Property

Upon receipt of full payment, DiVizion Creative Agency transfers ownership of all custom deliverables created for the client under the project agreement. We retain the right to display the work in our portfolio unless otherwise agreed in writing.

Any third-party assets, stock images, fonts, or software included in deliverables remain subject to their respective licenses and are not transferred to the client as original works.

5. Payment Terms

Payment terms are outlined in individual project agreements. Unless otherwise specified:

• An advance payment is required before project commencement
• Final payment is due upon delivery of completed work
• Late payments may incur interest at the rate permitted by applicable Latvian law

6. Revisions and Change Requests

The number of revision rounds included in a project is defined in the project agreement. Additional revisions or scope changes beyond the agreed scope may be subject to additional fees.

7. Limitation of Liability

To the maximum extent permitted by applicable law, DiVizion Creative Agency shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or deliverables. Our total liability shall not exceed the total fees paid by the client for the relevant project.

8. Termination

Either party may terminate a project agreement by providing written notice. In the event of termination, the client shall pay for all work completed up to the date of termination. Advance payments are non-refundable unless otherwise agreed.

9. Governing Law

These Terms of Service are governed by the laws of the Republic of Latvia. Any disputes arising from these terms shall be resolved in the courts of Riga, Latvia.

10. Changes to Terms

We reserve the right to update these Terms of Service at any time. Material changes will be communicated via email or prominent notice on our website. Continued use of our services after changes constitutes acceptance of the updated terms.
